Terms and conditions
As of 22 October 2026
1. Scope
These terms apply to all contracts between Said Zejjari, trading as PilatusWeb, Weinberglistrasse 9, 6005 Lucerne (PilatusWeb), and the client for websites, web apps, apps, relaunch, AI and security work, cloud backends, care, hosting where offered, and related work.
Client terms apply only if PilatusWeb accepts them in writing (email is enough). Consumers keep all mandatory rights under Swiss law.
2. Offer and contract
Website listings are not binding. A contract is formed when the client accepts an offer in writing, or when PilatusWeb confirms the order and starts the work.
Offers stand for 30 days unless they say otherwise. Changes after the contract, extra requests and delays caused by missing client materials are billed by effort.
3. Services
The offer sets the scope. Dates are targets, not fixed dates, unless they are expressly called a fixed date.
The client supplies texts, images, access and decisions on time and warrants the rights in those materials. PilatusWeb may refuse unlawful, misleading or infringing content.
PilatusWeb may use suitable subcontractors. Responsibility to the client stays with PilatusWeb.
4. Acceptance
After delivery the client checks the work within 10 days. Defects must be reported in writing, in a form that can be verified. Without a report the work is accepted. Putting the work into live use also counts as acceptance.
5. Prices and payment
Prices are in the offer, in Swiss francs. Whether VAT applies follows Swiss VAT law and is shown on the offer or invoice.
Invoices are due net within 30 days unless agreed otherwise. Advance or staged payment may be required. Default follows an unused reminder. Default interest is 5% per year. Set-off is allowed only against undisputed or finally judged claims.
If payment is late, PilatusWeb may pause the work, restrict access to unpaid work and, after a further deadline, withdraw from the contract.
6. Use rights
Drafts stay with PilatusWeb until paid in full. After payment the client receives a simple, time-unlimited right to use the delivered site or application for the agreed purpose.
Unless expressly agreed, this does not include source code of third-party parts, CMS cores, plugins, fonts, stock material or tools. Open-source licences prevail.
PilatusWeb may name the project in the portfolio after publication, unless the client objects in writing.
7. Hosting, domain, third parties
Where domain and hosting are offered, they run through third-party providers. Availability, backups and support follow their terms. Uninterrupted uptime is not promised.
8. Warranty
PilatusWeb will remedy proven defects that depart from the agreed quality, within a reasonable time, by repair. If repair fails, the client may claim a price reduction.
There is no warranty for search ranking, traffic, revenue, the behaviour of browsers, plugins or third-party services, or for content the client changes.
9. Liability
PilatusWeb is fully liable for intent, gross negligence and personal injury. For slight negligence, liability is limited to direct damage and to the net fee of the affected order. Indirect damage, lost profit and data loss are excluded for slight negligence where the law allows.
Mandatory claims remain. The client keeps their own backups of their content.
10. Confidentiality and data protection
Each side keeps non-public information from the work confidential. The duty continues after the contract ends.
Personal data is processed under the privacy notice. This website does not collect client data in an account or database. Enquiries and the working relationship run by email.
11. Term and end
One-off orders end with acceptance and payment. Care or hosting runs for an indefinite term and may be ended with 30 days’ notice to month-end, unless the offer says otherwise.
12. Final terms
Changes to these terms or the contract need writing. Email is enough. If a clause is invalid, the rest stays in force.
Swiss law applies, excluding the UN sales convention. Venue is Lucerne, unless a mandatory venue applies.
